Terms and Conditions of Use

Welcome to atsPulse, a cloud-based recruitment and applicant tracking solution owned and operated by Lipro Software Pvt. Ltd. Please read these Terms and Conditions (“Terms”) carefully before using the atsPulse platform (“Platform” or “Service”).

By accessing or using this Platform, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement under Indian law. By using the Platform, you confirm that you meet this requirement.

2. Use of the Platform

You are granted a non-exclusive, non-transferable, limited license to use the Platform for your internal recruitment and human resource management needs, including:

• Creating and managing job openings and applicant pipelines
• Collaborating with team members
• Accessing and analysing recruitment data and reports
• Communicating with applicants

Use of the Platform must comply with all applicable laws and these Terms.

3. Prohibited Activities

By using the Platform, you agree not to:

• Engage in unlawful or fraudulent activity
• Infringe upon intellectual property or privacy rights
• Interfere with or disrupt the Platform or its servers
• Attempt to gain unauthorised access to other accounts or data
• Use automated systems (e.g., bots or scrapers) without permission
• Share account credentials with unauthorised individuals

Violation of these restrictions may result in suspension or termination of your account.

4. Account Responsibility

You are responsible for maintaining the security and confidentiality of your account. All activities conducted through your account will be considered authorised by you. Notify us immediately if you believe your account has been compromised.

5. Intellectual Property

All components of the Platform, including software, design, and content (excluding user-uploaded data), are the property of Lipro Software Pvt. Ltd. or its licensors.

By uploading or inputting content into the Platform, you grant a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for providing the Service.

You may not copy, distribute, or alter any part of the Platform without prior written permission.

6. Data Privacy and Compliance

Your data is handled in accordance with our Privacy Policy, which complies with applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023.

You are responsible for obtaining appropriate consent from individuals (e.g., applicants) whose data is uploaded to the Platform.

7. Google API Disclosure (Calendar & Meet Integration)

atsPulse integrates with Google Calendar and Google Meet using Google’s restricted API scopes. Users must authenticate their own Google accounts to:

• Create and manage calendar events
• View and read scheduled events
• Automatically generate Google Meet links within calendar events

Google API Compliance

• Data is used strictly to support core functionality.
• Data is not shared with third parties or used for advertising.
• Users can revoke access via their Google Account settings.

By enabling this integration, you consent to Google API access as described.

8. Service Availability and Modifications

While every effort is made to ensure uninterrupted access, the Platform may be temporarily unavailable due to maintenance, updates, or technical issues.

Features and functionalities may be modified or enhanced at any time. Continued use of the Platform indicates acceptance of such updates.

9. Third-Party Integrations

The Platform may include links or integrations with third-party services (e.g., Google, Zoom, LinkedIn). Use of these services is subject to their respective terms and policies. atsPulse is not responsible for third-party content, features, or data handling.

10. Limitation of Liability

To the fullest extent permitted by law:

• The Platform is provided on an “as-is” and “as-available” basis.
• No warranties are made regarding accuracy, reliability, or suitability for a particular purpose.
• Lipro Software Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages, including loss of business, profits, or data.
• Total liability, if any, shall not exceed the amount paid by you for the Service in the preceding 12 months.

11. Termination

Access to the Platform may be suspended or terminated at any time for breach of these Terms or legal requirements. You may also terminate your use at any time by closing your account.

After termination, your access will end and your data may be retained for compliance or backup purposes in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and interpreted under the laws of India. Any legal disputes shall be subject to the jurisdiction of courts located in Faridabad, Haryana.

13. Changes to Terms

These Terms may be updated periodically. Significant changes will be communicated via email or platform notifications. Continued use after such changes constitutes acceptance of the new Terms.
